Elder Care Attorney

I have an appointment on Monday to speak to an Elder care Attorney, but I'm not sure what questions to ask. Any suggestions?

Bring any financial data you have—SS and pension receipts, life insurance policies, veterans discharge papers, stock balances, etc. the lawyer will need to have a good ballpark idea of how much income your family member has from what sources, names of beneficiaries, terms of pensions.
The more data or facts on finances you can bring, the better guidance the attorney can give you. Good estimates are ok if you can’t gather these papers before your visit.

Ask how long they've handled cases and whether someone in the office will be the patient's Authorized Representative to Medicaid or MediCal. California is the easiest state in the country, followed by Florida, for preserving resources even when someone is already receiving care.

Every state is different because Medicaid, though federally funded, is administered on the state level by state employees.

Bring everything financial, including most recent statements for all accounts and life insurance cash values with death benefit amounts and face values. Spouse's resources and incomes must be disclosed as well, though a spouse's income won't prevent a patient from qualifying no matter how high. Bring all legal docs: wills, POAs, trust docs, deeds, etc. Bring military discharge papers. If in doubt about bringing something, bring it.

A good practitioner can be well worth the fee considering the cost of mistakes and unintended consequences.

The only thing I would add to what Linda said is if you currently have any legal forms like POAs or wills bring them. Depending on when/where they were done they might need updating.

I don't know all of your specifics but, my fiancee is POA over his father both medical and durable POA. Although,he recently had to get a guardianship/conservator over him as well.
